Terms of Service

The general rules for using Svoltanic, for everyone with an account.

1. Who we are

These Terms form a binding agreement between you and [RAZÓN SOCIAL] ("we", "us"). By creating an account or using Svoltanic you accept them. If you do not accept them, do not use the service.

2. What Svoltanic does

Svoltanic is a marketplace that connects game developers with Twitch streamers. Developers list games and supply Steam keys; streamers promote those games under commission agreements; buyers purchase a key and may attribute the purchase to a streamer, who then earns the agreed commission.

We are an intermediary. The game itself is sold by the developer. We are not the publisher, author or warrantor of any game, and we do not control the content streamers broadcast.

Steam and Twitch are trademarks of Valve Corporation and Amazon.com, Inc. respectively. Svoltanic is not affiliated with, endorsed by, or sponsored by either company.

3. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your country, and legally able to enter into contracts.

You need an account to buy, apply for a role, or operate on the platform. You must give accurate information, keep it up to date, and keep your credentials secure. You are responsible for everything that happens under your account.

Accounts are personal and non-transferable. One person or legal entity may not maintain multiple accounts to evade limits, verification, suspensions or fees.

Access as a developer or creator is not automatic: it is granted only after you submit an application and our team approves it, and it can be revoked if the conditions that justified approval stop being true.

4. Verification

To approve a developer or creator application we verify identity and legitimacy. Depending on the role this may include: Twitch OAuth authorisation proving you control the channel; checking the game against public Steam store data; asking for two sample Steam keys to prove you can generate keys for the title; minimum account-age or audience thresholds; and identity/KYC verification performed by Stripe.

Giving false, borrowed or stolen information during verification is a serious breach: it leads to immediate rejection or permanent suspension, forfeiture of pending payouts, and may be reported to the affected parties and to the authorities.

We may re-run verification at any time and may pause an account while a verification is pending.

5. Purchases, prices and payments

Prices are set by the developer and shown in the listed currency, taxes included where applicable. The price charged is always the one calculated server-side at the moment of purchase.

Payments are processed by Stripe. We never see or store your full card details. By paying you also accept the terms of the payment provider.

After a successful payment we deliver a Steam key for the purchased game, on screen and by email. A purchase gives you a licence to the game granted by its publisher through Steam; your use of the game is additionally subject to Valve's and the publisher's terms.

Refunds are governed by the Refund Policy, which forms part of these Terms.

6. Commissions and payouts

Where a purchase is attributed to a creator, the sale amount is split according to the commission agreed in the active contract for that game, plus the Svoltanic platform fee and the payment-processing fee. The split is calculated server-side from the contract; it can never be set by the buyer or by client-side data.

Payouts to developers and creators run through Stripe Connect. To receive money you must complete Stripe onboarding and keep your connected account in good standing. Until then, amounts owed to you are recorded but held.

We may withhold, reverse or offset a payout in cases of chargeback, fraud, duplicate or self-referred purchases, breach of these Terms, or a legal obligation.

7. Acceptable use

You agree not to:

  • Use the service for anything illegal, or infringe anyone's intellectual property.
  • Sell keys you are not authorised to sell, or keys obtained through fraud, chargebacks or stolen payment methods.
  • Artificially inflate sales, commissions or audience: self-purchases through your own referral, coordinated purchase rings, bots, view-botting or fake accounts.
  • Circumvent, probe or overload the platform, its security controls or its rate limits.
  • Scrape, resell or redistribute platform data, or use it to build a competing dataset.
  • Harass, threaten, defame or discriminate against other users.

8. Content you provide

You keep ownership of what you upload (game pages, images, descriptions, messages, profiles). You grant us a worldwide, non-exclusive, royalty-free licence to host, display and distribute it as needed to operate and promote the service.

You warrant that you hold the rights to everything you upload and that it does not infringe third-party rights or applicable law.

We may remove content that breaches these Terms, the law, or third-party rights, and we may respond to well-founded takedown notices sent to [legal@svoltanic.com].

9. Suspension and termination

You may close your account at any time by contacting [soporte@svoltanic.com]. Obligations already incurred (delivered keys, pending payouts, chargebacks) survive closure.

We may suspend or terminate an account, with notice where reasonably possible, if you breach these Terms, if we detect fraud or a security risk, or if we are required to by law.

On termination we retain records required for accounting, tax and fraud-prevention purposes for the periods set out in the Privacy Policy.

10. Warranties and liability

The service is provided "as is". We do not warrant that it will be uninterrupted or error-free, nor do we warrant the quality, legality or performance of games listed by developers or of promotions run by creators.

To the maximum extent permitted by law, our aggregate liability towards you is limited to the greater of (a) the amounts you paid to or through Svoltanic in the three months before the event, and (b) EUR 100. We are not liable for indirect or consequential damages, loss of profits or loss of data.

Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury, or any liability that cannot be limited under applicable law, including the statutory consumer rights of buyers.

11. Changes

We may update these Terms. Substantive changes are announced in the app and, where required, by email, and take effect when you next accept them. Each document carries a version number and you are asked to accept it again when it changes.

The version in force and its date are shown in the header of this page.

12. Governing law and disputes

These Terms are governed by the law of [PAÍS]. Disputes are subject to the courts of [CIUDAD Y PAÍS DE JURISDICCIÓN], without prejudice to any mandatory forum available to you as a consumer in your country of residence.

Before litigating, please write to [legal@svoltanic.com], most issues are resolved faster that way. Consumers in the EU may also use the European Commission's Online Dispute Resolution platform.
